Legal Battle Over Accuser Identity in Evolution Gaming Case

The unfolding legal drama began when a New Jersey superior judge instructed the law firm defending the anonymous claimant against Evolution, a company known for its live dealer casino gaming services, to disclose their clients’ identities. This development has introduced a new chapter in the ongoing narrative.

Identity of Evolution’s Accusers to Remain Concealed Until Early April

In late February, Judge John C. Porto sided with Evolution, demanding that Calcagni & Kanefsky LLP reveal the identities of their clients within a week. This would have meant that Evolution’s legal representatives would learn the identities by either Friday, March 7, or Monday, March 10.

Nevertheless, Calcagni & Kanefsky LLP submitted a brief requesting a suspension of the order. They argued that disclosing their client’s identity would compromise client privilege and set a potentially harmful precedent for future cases. In response, Evolution promptly prepared for an oral argument to address the matter.

Instead of making an immediate decision, the judge announced that he would hear the case on Friday, March 28. This extension provides Calcagni & Kanefsky LLP additional time to prepare and gives the anonymous accusers a moment to brace themselves for the potential consequences of their identities being exposed to Evolution.

Back in 2021, a report circulated widely through the media, suggesting that Evolution’s live casino offerings were accessible via numerous offshore gambling platforms, some of which targeted regulated markets without the appropriate licenses.

The circulation of this report led to a dramatic $3 billion decline in stock value, marking one of the most substantial impacts on a gaming company’s share price. Since the report’s release, Evolution has consistently asserted its innocence.

Subsequent investigations by the New Jersey Division of Gaming Enforcement and the Pennsylvania Gaming Control Board absolved Evolution of any misconduct, concluding that the report was founded on inaccurate claims.

Investigations Conclude Evolution’s Innocence

Initially, Evolution’s request to uncover the identity of the accusers was denied, primarily because the court had yet to determine the report’s factual basis and legitimacy. With the PGCB and DGE’s investigations backing Evolution, this barrier appears to have been lifted.

Despite this, the accusers will remain anonymous for another month, with the prospect of their identities being unveiled in early April. Whether their names will be made public remains uncertain and rests entirely in Evolution’s hands.
