In recent months, the prediction markets platform Kalshi has been under mounting scrutiny, yet it remains proactive and resilient.

Despite facing challenges in multiple states, the prediction markets app and company has taken an assertive approach, successfully contesting the Nevada Gaming Control Board in court. It has also obtained a temporary injunction against a cease-and-desist order that sought to halt its sports future-event contracts.

Kalshi Confronts Maryland’s Gambling Regulator in Court

The platform is now targeting the Maryland Lottery and Gaming Commission, which has issued Kalshi a cease-and-desist notice, accusing the platform of offering services that resemble sports betting.

Kalshi fervently disputes this claim, arguing that its prediction markets should fall under the jurisdiction of the Commodity Futures Trading Commission, rather than being regulated as gambling.

The company is also challenging the New Jersey Division of Gaming Enforcement, with a decision still pending.

Kalshi insists that only the CFTC has the authority to determine which prediction markets are prohibited. Furthermore, since Kalshi does not set the odds itself, it argues that it is not akin to traditional gambling companies like DraftKings or FanDuel.

However, Kalshi faces opposition from numerous state authorities. Regulators in Illinois, Michigan, Montana, Ohio, Connecticut, Kansas, and Washington have all issued cease-and-desist orders against the platform.

The partial victory in Nevada does not guarantee the outcome of other legal challenges, as there is growing concern over how the Wire Act might be interpreted to Kalshi’s disadvantage.

A potential issue is that the Wire Act effectively forbids the interstate transmission of data, which could complicate Kalshi’s current business model. Unlike conventional oddsmakers, Kalshi aggregates data rather than operating individual state-focused sub-entities.

The Wire Act and the Continued Challenges for Kalshi

Does the Wire Act truly apply to Kalshi? This is a question regulators must explore. Although the situation in Nevada is currently calm, a temporary injunction does not equate to Kalshi eliminating all opposition, and regulators may attempt to demonstrate that Kalshi cannot conduct business in the state.

Meanwhile, DraftKings, a traditional sports betting platform, considered launching its own prediction platform but may be reevaluating this decision.

Kalshi’s platform has gained popularity among younger sports enthusiasts who are willing to embrace ‘prediction markets’ if they find the experience more engaging.
